Harvey Weinstein is not being retried for a rape charge.
Prosecutors confirmed they will not retry the 74-year-old film producer, who was accused of rape by Jessica Mann, following a May mistrial, via THR.
They decided not to pursue a retrial based on discussions with Jessica, who didn’t want to testify again after multiple testimonies in front of juries over the years.
“To be clear, we believe Ms. Mann’s account and her credibility as a witness. This has been an extraordinarily taxing ordeal for her, and she has never wavered while testifying in front of two grand juries and three trial juries over the course of eight years. We thank her for her honesty and her tremendous bravery,” Manhattan D.A. Alvin Bragg said in a statement, via the outlet.
The office now moves forward with sentencing recommendations, as they were holding off until the Jessica Mann charge was sorted out.
They are recommending 20 years in prison for Harvey for a criminal sexual act conviction involving former Project Runway assistant Miriam Haley, “which would account for the significant harms his actions have caused Ms. Haley,” the D.A. said.
Harvey was convicted of raping Jessica in 2020, as well as sexually assaulting Miriam. It was overturned in 2024 because the Court of Appeals in New York ruled that the trial judge allowed women uninvolved in the allegations to testify.
The prosecutors sought a retrial a year later in 2025, and Harvey was convicted of criminal sexual act against Miriam, and cleared of a similar charge against model Kaja Sokola. The jury was unable to reach a verdict on the charge related to Jessica Mann, resulting in a mistrial.
Another trial this past spring involving the charge also led to a mistrial. The decision means Harvey will not face a fourth trial on the Jessica Mann charge.
He remains behind bars and is also serving a separate 16-year prison sentence stemming from his 2022 Los Angeles conviction.
